Idera Sues USPTO To Extend Cancer Treatment Patents

Law360, New York (February 08, 2010, 4:16 PM ET) -- Citing the recent decision in Wyeth v. Kappos, Idera Pharmaceuticals Inc. has sued the U.S. Patent and Trademark Office, claiming the patent authority miscalculated an extension for two of its patents covering a cancer treatment by a year and a half.

In an amended complaint filed Wednesday in the U.S. District Court for the District of Columbia, Idera said that David J. Kappos, director of the USPTO, had approved an extension for the patents using a method recently invalidated by a federal appeals court.
