Fed. Circ. Nixes Pfizer Bid To Keep Lipitor IP Suit In Del.

Law360, New York (February 05, 2010, 6:13 PM ET) -- A federal appeals court on Friday denied Pfizer Inc.'s bid to keep a patent infringement suit seeking to prevent Apotex Inc. from marketing a generic version of cholesterol drug Lipitor in the U.S. District Court for the District of Delaware.

A three-judge panel of the U.S. Court of Appeals for the Federal Circuit issued an order denying Pfizer's petition for a writ of mandamus that would have directed the District of Delaware to vacate a decision that transferred the case to the Northern District of Illinois....
