Ruling Favors Burlington In Louis Vuitton Trademark Suit

Law360, New York (May 27, 2004, 12:00 AM ET) -- A U.S. District Court has denied Louis Vuitton’s motion for a preliminary injunction to bar retail chain Burlington Coat Factory from selling a line of ladies handbags that Vuitton claimed infringed its trademarks.

Louis Vuitton Malletier, a subsidiary of LVMH Moët Hennessy, had asked the U.S. District Court for the Southern District of New York for an injunction barring Burlington Coat Factory from selling a line of beaded handbags decorated with the monogram “NY” and diamonds, flowers and stars in a diagonal criss-cross pattern.
