Appeals Court Remands Syringe Patent Case

Law360, New York (January 25, 2007, 12:00 AM ET) -- An appeals court has remanded MBO Laboratories’ infringement case over its patent for syringe safety features, reversing a district court's decision to throw out the case based on claims construction.

MBO sued Becton, Dickinson & Co. in 2003, alleging that Becton’s device, the B-D SafetyGlide Shielding Hypodermic Needle, infringed one of its patents covering a similar technique.
