Law360, New York (February 09, 2007, 12:00 AM ET) -- Sanofi-Aventis was dealt a blow in its attempt to prevent a generic version of its popular anti-clotting drug Lovenox when a U.S. District Court judge ruled that the drug maker was deceptive when it applied for the patent for the drug.
Judge Mariana R. Pfaelzer ruled Thursday that Sanofi-Aventis’ patent for Lovenox was unenforceable because the drug maker intended to deceive the U.S. Patent and Trademark Office during its patent application.
