Boniva ANDAs Infringe Roche Patent: Judge

Law360, New York (August 25, 2010, 2:07 PM ET) -- Hoffmann-La Roche Ltd. has won summary judgment that Apotex Inc. and Cobalt Pharmaceuticals Inc.'s planned generic versions of bone loss prevention drug Boniva infringe one of two patents left at issue in Roche's slew of suits against the generics makers.

The Canada-based defendants' abbreviated new drug applications seeking approval from the U.S. Food and Drug Administration to make generic Boniva literally infringe one of Roche's patents, Judge Stanley R. Chesler ruled Tuesday in the U.S. District Court for the District of New Jersey.
