Caraco Seeks Judgment On Lexapro Patent

Law360, New York (February 22, 2007, 12:00 AM ET) -- In an attempt to horn in on the lucrative market for depression drug Lexapro, Caraco Pharmaceutical Laboratories Ltd. has filed a lawsuit looking to force a court ruling on a patent licensed to Forest Laboratories Holdings Ltd.

The lawsuit seeking declaratory judgment was filed in Michigan on Tuesday against defendants Forest Laboratories Inc., Forest Laboratories Holdings Ltd. and H. Lundbeck A/S.

The patents which the defendants claim cover Lexapro are U.S. Patent Numbers Re. 34,712 and 6,916,941. Forest has already sued Caraco for infringing the ‘712...
