AmEx Wins Judgment In PrivaCash Gift Card Patent Suit

Law360, New York (October 05, 2010, 7:16 PM ET) -- A federal judge has sided with American Express Co. in a suit brought by a prepaid gift card retailer that accused AmEx of infringing its patent on “open loop” gift cards used to make purchases online.

Magistrate Judge Stephen Crocker of the U.S. District Court for the Western District of Wisconsin ruled Monday that MasterCard gift card retailer PrivaCash Inc. failed to offer sufficient proof that AmEx gift cards infringed a PrivaCash patent, partially granting AmEx summary judgment.
