Law360, New York (December 06, 2010, 3:11 PM ET) -- Weight Watchers International Inc. has laid down the sword in its lawsuit against competitor Curves International Inc., scoring a permanent injunction that prevents the fitness franchise from running commercials that allegedly infringe on Weight Watchers' weight loss systems trademarks.
In a permanent injunction approved Friday by Judge Miriam Goldman Cedarbaum of the U.S. District Court for the Southern District of New York, Curves agreed to cease broadcasting its so-called Something New commercials, which Weight Watchers claimed constituted trademark infringement, false advertising and unfair competition.
