IBM Defenses May Get New Life In TecSec Patent Spat

Law360, New York (February 07, 2011, 12:33 PM ET) -- IBM Corp. has convinced a federal judge to reconsider her previous ruling nixing the company's affirmative defenses in relation to two patents in a suit brought by TecSec Inc. over six patents covering data encryption technology.

Judge Leonie M. Brinkema of the U.S. District Court for the Eastern District of Virginia granted IBM's motion for reconsideration Friday, meaning that IBM's assertion that two of the patents-in-suit are invalid because they were anticipated by prior art could proceed to trial.
