Lime Wire Per-Song Damages In Play For Labels: Judge

Law360, New York (April 04, 2011, 10:00 PM ET) -- A New York federal judge ruled Monday that record companies suing Lime Wire LLC are entitled to per-song — not per-album — damages, an upset for the defendant accused of infringing copyright laws with its LimeWire file sharing service.

Statutory copyright damages should be assessed per-song for any song released as a single before it was copied by Lime Wire, said Judge Kimba M. Wood of the U.S. District Court for the Southern District of New York — a ruling that could have multimillion-dollar implications....
