Law360, Los Angeles (September 09, 2011, 6:25 PM ET) -- A New Jersey federal judge on Friday threw out former Rutgers University quarterback Ryan Hart’s class action claiming Electronic Arts Inc. had misappropriated college football players’ likenesses by featuring virtual versions of them in the video game “NCAA Football.”
“On balance, on the facts of this case, defendant’s First Amendment right to free expression outweighs plaintiff’s right of publicity,” Judge Freda Wolfson said. “Accordingly, the court grants defendant’s motion for summary judgment.”
