Law360, New York (September 15, 2011, 7:24 PM ET) -- A Saint-Gobain SA unit asked the U.S. Supreme Court earlier this month to review a $45 million judgment against it for allegedly infringing a Siemens AG patent covering medical scanning technology, arguing the lower courts used the wrong standard for determining infringement.
A jury ruled, and the Federal Circuit affirmed, that a positron emission tomography scanner for which Saint-Gobain Ceramics & Plastics Inc. holds a patent infringed a patent held by Siemens for a different PET scanner under the doctrine of equivalents.
