Law360, New York (January 14, 2005, 12:00 AM ET) -- Canadian artists have filed an appeal with the Supreme Court to overturn last month's Federal Court of Appeal decision striking down a copyright levy on digital audio recorders such as Apple’s iPod.
The Canadian Private Copying Collective, which represents composers, record labels, publishers and others, claimed the appeals court had erred in December, when it ruled that the Copyright Board of Canada couldn't let the CPCC collect a tariff based on the permanent memory capacity found in digital audio recorders.
