Law360, New York (November 07, 2011, 1:25 PM ET) -- The U.S. Supreme Court on Monday asked the solicitor general to weigh in on a case in which a Saint-Gobain SA unit argues lower courts used the wrong standard for determining that it infringed a patent held by Siemens AG for medical scanning technology.
Both Saint-Gobain Ceramics & Plastics Inc. and Siemens hold patents on positron emission tomography scanners, but a jury found that Saint-Gobain's product infringed Siemens' patent under the doctrine of equivalents and awarded it $45 million.
