Law360, New York (January 04, 2012, 4:55 PM ET) -- A lower court's denial of Christian Louboutin SA's request to bar Yves Saint Laurent America Inc. from selling shoes with red soles must be affirmed to ensure freedom of innovation, a group of law professors urged the Second Circuit on Tuesday.
Louboutin, which holds a trademark on red-soled shoes, appealed the ruling by U.S. District Judge Victor Marrero that Louboutin said amounted to a "sweeping and unsupported" finding that no color can serve as a trademark on a fashion item.
