Law360, New York (February 02, 2012, 10:30 PM ET) -- A Washington federal judge on Thursday nixed a breach of fiduciary duty claim from a $250 million suit alleging Dickstein Shapiro LLP was guilty of manifest negligence in its handling of Encyclopedia Britannica Inc.'s intellectual property, but refused to toss the main negligence claim.
U.S. District Judge John D. Bates granted in part the firm's motion to dismiss, agreeing with the argument that the publisher had failed to allege sufficient facts in support of a breach of fiduciary duty claim.
