EU Suspends ACTA Ratification For High Court Inspection

Law360, New York (February 22, 2012, 3:38 PM ET) -- Facing stiff criticism and protests, the European Commission said Wednesday that it was referring the Anti-Counterfeiting Trade Agreement to the European Court of Justice to independently clarify the legality of the pact.

Commissioner Karel De Gucht said the commission will ask the Court of Justice whether ACTA is incompatible with the European Union's fundamental rights and freedoms, such as freedom of expression and information or data protection.
