Law360, New York (February 27, 2012, 7:51 PM ET) -- A photographer urged the First Circuit on Friday to revive his copyright infringement suit against Sony Pictures Television Inc. and A&E Television Networks LLC over the studios' recreation of a picture of convicted kidnapper Clark Rockefeller and daughter Reigh for a made-for-TV movie.
In a brief made public Friday, photojournalist Donald Harney argued that U.S. District Judge Rya W. Zobel erred in awarding Sony and A&E summary judgment last May, saying the judge overdissected Harney's photograph and overlooked key aspects of the image's originality.
