Law360, New York (May 02, 2012, 2:20 PM ET) -- A new rule allowing U.S. Customs and Border Protection agents to share information with intellectual property owners as part of investigations into counterfeit goods will help to root out knockoffs, but just how the rule will impact the gray market industry remains to be seen, attorneys say.
The rule, which went into effect on April 24, effectively reverses a 2008 Customs directive that barred agents from giving brand owners bar codes and other identifying markings on suspected counterfeit goods detained at the border.
