Judge Allows Teva To Launch Generic Herpes Drug

Law360, New York (September 05, 2007, 12:00 AM ET) -- A New Jersey federal court judge has opened the door for Israel-based drug maker Teva Pharmaceutical Industries Ltd. to launch a generic version of genital herpes drug Famvir after denying Novartis AG’s bid for a preliminary injunction.

U.S. District Judge Dennis M. Cavanaugh ruled against Novartis’ request for an injunction on Wednesday in its patent infringement case against Teva. He said that the Swiss drug manufacturer’s patent — U.S. Patent Number 5,246,937 — was obvious and unenforceable based on the merits of the case.
