Calif. Judge Won't Halt Sale Of Prenatal Blood Test In IP Row

Law360, New York (July 06, 2012, 6:44 PM ET) -- A federal judge on Thursday allowed Ariosa Diagnostics Inc. to continue selling its noninvasive prenatal Harmony test, dismissing competitor Sequenom Inc.’s motion for a preliminary injunction claiming the product infringes on its patent for a competing test.

Ariosa began marketing the test in March, after suing Sequenom in federal court in California in December for declaratory relief stating it did not infringe on its rival’s patent.
