Law360, New York (October 01, 2007, 12:00 AM ET) -- Dietary supplement maker Iovate Health Sciences Research Inc. sued rival Nutrabolics Inc. on Thursday, alleging Nutrabolics infringed three of its patents for muscle-building supplements, used deceptive packaging and advertising, and broke an agreement concerning a different patent dispute.
Iovate said in the complaint that at least four of Nutrabolics' products willfully infringed one or more of its patents.
“As a result of defendant's acts of infringement, plaintiffs have suffered and will continue to suffer damages in an amount to be proved at trial,” Iovate said....
