Boston Scientific's Patent Suit Against J&J Heads To Jury

Law360, New York (July 01, 2005, 12:00 AM ET) -- In the last of three lawsuits between Boston Scientific Corp. and Johnson & Johnson Inc. over patent rights to cardiovascular stent technology, the jury convened Friday to begin deliberations in Boston Scientific’s patent lawsuit against J&J.

Boston Scientific, which lost two earlier trials to J&J over the lucrative technology, claims J&J's Cypher drug-eluting stent infringes its patents.

In closing arguments on Thursday, Patterson Belknap partner Gregory Diskant told the jury that Johnson & Johnson didn’t infringe Boston Scientific’s patents, which he said were invalid.
