Law360, New York (July 27, 2012, 7:08 PM ET) -- The Federal Circuit have shot down a move by the Public Patent Foundation Inc. to have all the judges of the court consider whether a law that stripped most false patent marking plaintiffs of standing is constitutional.
In a brief one-page order issued July 23, the Federal Circuit also declined to allow an immediate appeal of the case to the U.S. Supreme Court. The appeals court denied the petition for an en banc review and the motion for summary affirmance without comment.
