Law360, New York (December 19, 2012, 7:08 PM ET) -- A New York federal judge on Friday ordered DataTern Inc. to stop suing customers of SAP AG for patent infringement based on products sold by SAP, saying that her August ruling gutting the patent-licensing company's claims prohibits such action.
Relying heavily on the U.S. Supreme Court’s decision in Kessler v. Eldred, U.S. District Judge Katherine B. Forrest enjoined DataTern from pursuing infringement claims for U.S. Patent Numbers 5,937,402 and 6,101,502 against SAP customers that use SAP’s BusinessObjects software.
