Law360, New York (January 30, 2013, 4:03 PM ET) -- A California federal judge on Tuesday refused to toss a lawsuit claiming Madonna secretly copied portions of a copyrighted disco track for her 1990 hit “Vogue,” ruling it was too early to kill the case.
U.S. District Judge Stephen V. Wilson denied Madonna's motion to dismiss VMG Salsoul LLC's suit, which accuses her and the song's co-writer Shep Pettibone of illegally sampling VMG's 1977 song “Love Break.” The company says the theft was only detected only when new technology became available in 2011.
