Law360, New York (February 15, 2013, 3:21 PM ET) -- The Federal Circuit on Friday reversed the U.S. Patent and Trademark Office's rejection of an application for a patent on a method of diagnosing failures in memory storage devices, finding that the office wrongly found the invention to be anticipated.
In a nonprecedential opinion, the appeals court sided with inventor Eric Jasinski, who argued that the USPTO failed to give the proper weight to certain language in his patent application and incorrectly held that a previously issued patent covered the same invention.
