Law360, New York (February 21, 2013, 2:45 PM ET) -- A Tennessee federal judge on Wednesday tossed AntiCancer Inc.'s lawsuit claiming Berthold Technologies Inc. encouraged university researchers to infringe the biotech firm's patented method for monitoring tumor cell growth.
U.S. District Judge Thomas A. Varlan granted summary judgment to Germany-based Berthold on allegations that it induced scientists at the Massachusetts Institute of Technology and Indiana University to copy two AntiCancer patents for using fluorescent proteins to track the spread of cancer.
