Law360, New York (February 21, 2013, 4:51 PM ET) -- Essex Insurance Co. on Wednesday sued doll maker Broder Concepts Inc. to dodge coverage for trademark infringement and unfair competition litigation over a doll with a built-in picture frame.
Essex said said the events the led to the underlying lawsuit occurred before the coverage period for its general liability policy covering Broder from November 2011 to November 2012 for personal and advertising injury claims, adding that even if the events were timely, the company’s claims would be subject to exceptions in the policy.
