Law360, New York (March 07, 2013, 3:33 PM ET) -- The European Union’s highest court on Thursday handed a sharp rebuke to TVCatchup Ltd., which rebroadcasts live streams of free-to-air television over the Internet, finding that broadcasters are within their rights to prohibit such retransmissions.
The European Court of Justice found that pursuant to a 2001 EU copyright law, TVCatchup’s online rebroadcasts constitute communications of a broadcaster’s protected works to the public, and as such, each retransmission must be individually authorized by the broadcaster, or "author."
