Halliburton Loses Appeal Over Rejected Fracking Patent

Law360, Los Angeles (March 28, 2013, 5:19 PM ET) -- A U.S. Patent and Trademark Office panel on Thursday denied Halliburton Energy Services Inc.’s appeal of an examiner’s decision to reject a patent that sought to cover an improved fracking method, saying many of the claims were obvious from prior art.

The Patent Trial and Appeal Board upheld the examiner’s rejections of a slew of claims, saying the examiner didn’t err when it found that the subject matter of the claims is unpatentable over the combined teachings of earlier patents issued in 1985, 1990 and 1995....
