Savient, Upsher-Smith Settle Oxandrin Patent Dispute

Law360, New York (August 14, 2008, 12:00 AM ET) -- A federal judge has dismissed a patent lawsuit filed by Savient Pharmaceuticals Inc. over Upsher-Smith Laboratories Inc.'s generic version of weight-gain drug Oxandrin after the companies agreed to settle the case.

Judge Peter G. Sheridan of the U.S. District Court for the District of New Jersey ordered the case dismissed with prejudice on Tuesday. The companies jointly requested the dismissal, according to the order.
