Judge Nixes $1.7M Verdict In Dust-Control Patent Suit

Law360, New York (September 18, 2008, 12:00 AM ET) -- A federal judge has overturned a jury verdict that awarded Texas construction contractor CCC Group Inc. $1.7 million in a patent dispute with Martin Engineering Co. over a method for controlling dust emissions.

In a ruling issued Wednesday, Judge Richard P. Matsch of the U.S. District Court for the District of Colorado said CCC failed to prove Martin Engineering infringed the patent-in-suit, either literally or under the doctrine of equivalents.
