Law360, New York (September 24, 2008, 12:00 AM ET) -- A federal judge has rejected Teva Pharmaceutical Industries Ltd.'s summary judgment bid in AstraZeneca PLC’s suit seeking to block Teva from launching a generic version of children's asthma drug Pulmicort Respules.
On Tuesday, Judge Renee Marie Bumb of the U.S. District Court for the District of New Jersey denied Teva’s motion that it did not infringe AstraZeneca’s patents covering the drug through its attempt to gain federal approval for Pulmicort Teva. The case is likely to head to trial by January 2009, according to AstraZeneca....
