Law360, New York (December 08, 2008, 12:00 AM ET) -- Cisco Systems Inc. has moved to throw out a defamation lawsuit brought against it over comments the company's former director of intellectual property made in the notorious “Patent Troll Tracker” blog.
In a motion for summary judgment filed Nov. 26 in the U.S. District Court for the Eastern District of Texas and then unsealed Friday, Cisco said that blogger Rick Frenkel's comments were true as a matter of law and that the plaintiff, attorney Eric M. Albritton, was a public figure who must demonstrate actual malice....
