Law360, New York (February 09, 2009, 12:00 AM ET) -- Monsanto Co. has filed a patent suit against father-and-son Michigan soybean farmers, accusing them of planting the agricultural giant's pesticide-resistant seeds without paying the proper royalties.
The lawsuit, filed Friday in the U.S. District Court for the Northern District of Michigan, alleges Earl and Richard Schroeder knowingly and willfully planted and saved Monsanto's Roundup Ready seed without authorization.
Monanto’s pesticide-resistant soybean seeds are protected under U.S. Patent Numbers 5,352,605 and RE 39,247.
