Law360, New York (January 04, 2010, 7:00 PM ET) -- In a fight with the Internal Revenue Service over tax accrual documents, global conglomerate Textron Inc. has petitioned the U.S. Supreme Court to clarify whether the work product privilege extends beyond documents prepared for use in litigation.
Attorneys for the company filed a petition for writ of certiorari Dec. 24 seeking a review of the U.S. Court of Appeals for the First Circuit's August en banc ruling that attorneys' work product privilege does not protect documents created in preparation of a company's corporate financial statements....
