4th Circ. Chides NC Prosecutors Over Discovery Errors

Law360, New York (August 27, 2013, 6:35 PM ET) -- Though affirming the fraud conviction of a former securities attorney, the Fourth Circuit scolded federal prosecutors in North Carolina on Friday for increasingly prevalent discovery “flubs,” urging district officials to prevent future abuses.

Gregory Bartko's appeal of a 2010 conviction served as a springboard for addressing a history of alleged discovery abuse by the U.S. Attorney's Office for the Eastern District of North Carolina, but it didn't win the ex-attorney a new trial.
