Calif. Court OKs Transfer Of Malpractice Claim To Insurer

Law360, New York (November 26, 2013, 7:40 PM ET) -- A California appeals court on Tuesday carved out a narrow exception to a rule blocking the transfer of legal malpractice claims, finding that White Mountains Reinsurance Co. of America could pursue its lawsuit against Borton Petrini LLP.

Reversing a trial court's decision, the appeals court found that White Mountains had standing to accuse Borton of committing malpractice by not taking action on a $100,000 compromise offer from a woman who was seriously injured in a car accident caused by a policyholder that White Mountains' predecessor insured....
