NY Advisory Council Proposes To Truncate Biz Cases

Law360, New York (December 09, 2013, 2:04 PM ET) -- A council tasked with streamlining New York's commercial court published a proposed rule Monday that could give businesses the ability, while entering into contracts, to waive time-consuming litigation tactics, including forum fights and midcase appeals, and limit electronic and regular discovery.

A subgroup of the Commercial Division Advisory Council tasked with promoting efficient case resolution procedures proposed the rule related to accelerated adjudications that could see companies waiving possible litigation tactics that could slow down litigation and ramp up its costs.
