Judge Dismisses Bavarian’s Trade Secrets Case

Law360, New York (May 16, 2007, 12:00 AM ET) -- A judge dismissed a lawsuit Tuesday in which Bavarian Nordic had accused rival pharmaceutical company Acambis PLC of producing a smallpox vaccine with stolen research.

In granting Acambis’ motion for summary judgment, Judge Sue L. Robinson of the U.S. District Court for the District of Delaware ruled that Bavarian Nordic’s trade secrets allegations were without basis in law or fact.

“The court concludes that plaintiffs have failed to carry their burden of proof,” Judge Robinson wrote.
