Fed. Circ. Finds Respironics' Apnea Patents Invalid

Law360, New York (July 08, 2011, 4:47 PM ET) -- The Federal Circuit on Friday ruled that two Respironics Inc. patents for sleep apnea treatments were invalid as anticipated by prior art, reversing a lower court and handing a victory to accused infringer Invacare Corp.

Overturning a Pennsylvania federal court's decision, the appeals court held that Invacare had demonstrated that Respironics' patents were anticipated by a 1987 article penned by respiratory therapy specialist Magdy Younes.
