Law360, New York (August 26, 2011, 3:39 PM ET) -- Alcon Pharmaceuticals Ltd. filed a patent infringement suit against Apotex Inc. in Texas on Thursday in an effort to keep the Canadian drug company from developing its own version of seasonal allergy relief nasal spray Patanase.
Alcon, a subsidiary of Novartis AG, lodged the suit in response to Apotex's filing of an abbreviated new drug application with the U.S. Food and Drug Administration to sell a generic olopatadine hydrochloride product before the plaintiff's patent for the drug expires.
