Law360, New York (December 06, 2011, 5:08 PM ET) -- Alkem Laboratories Ltd. on Tuesday moved to block Shire Canada Inc.'s voluntary dismissal of its Illinois suit accusing the drugmaker of infringing its patents for kidney failure treatment Fosrenol, saying the dismissal would delay Alkem from getting its generic to market.
Alkem said in Illinois federal court that Shire's offer of a covenant not to sue would not qualify under the Hatch-Waxman Act as a triggering event that would allow Alkem to expedite its Fosrenol copy through the U.S. Food and Drug Administration's generics approval process....
