Law360, New York (April 12, 2012, 3:36 PM ET) -- The federal government on Tuesday accused Johnson & Johnson of “hiding the ball” with respect to its defense strategy in two Omnicare Inc. employees' False Claims Act case over an alleged kickbacks scheme, urging a judge to compel testimony by J&J's chief executive.
J&J faces allegations that it paid Omnicare Inc., the nation’s largest pharmacy for nursing homes, to disregard cheaper rival drugs and promote J&J products. The scheme allegedly resulted in false claims being submitted to Medicare and Medicaid.
