6th Circ. Won't Overturn Fen-Phen Attys' Convictions

Law360, New York (May 01, 2012, 4:11 PM ET) -- The Sixth Circuit on Tuesday affirmed the convictions of two attorneys who kept for themselves millions in class settlement funds meant for victims of the defective diet pill fen-phen, finding their arguments that they had never intended to defraud anyone unpersuasive.

The three-judge panel said in its opinion that a jury was right to convict William Gallion and Shirley Cunningham on eight counts of wire fraud, and that the Eastern District of Kentucky was right to sentence Cunningham to 20 years and Gallion to 25 years...
