Sales Reps Say GSK Ruling Doesn't Bar State OT Claims

Law360, New York (July 03, 2012, 1:56 PM ET) -- Sales representatives on Monday urged a Illinois federal judge to keep alive an overtime suit against Boehringer Ingelheim Pharmaceuticals Inc., arguing their claims were not barred by the U.S. Supreme Court's recent decision that GlaxoSmithKline PLC sales reps were exempt from federal overtime pay requirements.

Lead plaintiffs Catherine Copello and Annette Allen contended that last month's decision by the Supreme Court in Christopher v. SmithKline Beecham Corp. did not block their state law claims, arguing the Illinois state law was not identical to the Fair Labor...
