Law360, New York (July 13, 2012, 9:58 PM ET) -- Teva Pharmaceutical Industries Ltd. unit Cephalon Inc. on Thursday hit the Travelers Companies Inc. with a suit to block the insurer from trying to recoup some $17 million it claims it paid to cover prescriptions for off-label uses of cancer pain medication Actiq.
In a complaint filed in New York federal court, Cephalon said Travelers was seeking the payment even though Cephalon stopped actively promoting the drug six years ago, and despite a 2008 settlement Cephalon entered into with federal authorities in 2008.
