Law360, New York (December 10, 2007, 12:00 AM ET) -- A Texas federal court would forego judicial economy and risk inconsistent verdicts if it separates Retractable Technologies Inc.'s antitrust and patent infringement claims against rival medical technology maker Becton Dickinson and Co.'s, according to Retractable.
Retractable filed an opposition on Friday in the U.S. District Court for the Eastern District of Texas to Becton's motion to sever the claims, which accused Becton of infringing three patents, false advertising and unfair competition in order to shut out Retractable from the safety syringe market.
